Terms of Service
Welcome to Fibonacci Impact LLC (“Company”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of our websites (including fib.im and other sites we operate) and apps, including Socials at socials.fib.im.
By using our services, you agree to these Terms. If you do not agree, do not use our services.
1. Use of Our Services
You agree to use our services legally, ethically, and in accordance with these Terms.
You must be at least 18 years old, or the age of majority where you live, to use our services.
We may suspend or terminate your access without notice if you violate these Terms.
2. User Accounts
If you create an account, you are responsible for keeping your login information confidential.
You are responsible for all activities that occur under your account.
3. Purchases and Payments
All sales are final unless stated otherwise. Please review any product-specific refund policies before purchasing.
We reserve the right to change pricing at any time.
4. User-Generated Content
You retain ownership of the content you submit. You grant us a worldwide, royalty-free licence to host, store, reproduce, adapt for technical purposes such as format conversion, and transmit that content solely to operate the services for you — including publishing it to the destinations you select. This licence exists so that we can do what you have asked us to do, and it ends when you delete the content or your account, except for copies that remain in backups for a limited period.
You are responsible for the content you submit. We are not obliged to monitor it, and we may remove content or refuse to publish it at our discretion.
5. Publishing to Third-Party Platforms
Our Socials app publishes your content to third-party platforms — including TikTok, Instagram, Facebook, YouTube, X, LinkedIn, Pinterest, Threads, and Google Business Profile — at your instruction. When you use it:
- You are the author and publisher. We act only on your instruction, and you decide what is published, where, and when.
- You confirm you hold the necessary rights to everything you publish, including the video, images, text, and any music or other material within it, and that publishing it does not infringe anyone’s rights.
- Each platform’s own rules apply to you. You remain bound by the terms, community guidelines, and content policies of every platform you publish to. For TikTok this includes its Community Guidelines, its Music Usage Confirmation, and, where your content promotes a brand, product, or service, its Branded Content Policy — and it is your responsibility to disclose commercial content where those rules require it.
- Platforms decide what happens to your content. A platform may reject, restrict, label, or remove a post, or suspend your account there, for reasons outside our control and without notice to us.
- We are independent of these platforms. We are not affiliated with, endorsed by, or sponsored by any of them. Their names and logos are the trademarks of their respective owners and are used only to identify the destination you are publishing to.
6. AI Tools and Content
Some services use artificial intelligence. We do not guarantee the accuracy, reliability, or safety of AI-generated content. Use AI content at your own risk.
7. No Warranties
Our services are provided “as is” and “as available” without warranties of any kind.
We do not guarantee that our services will be error-free, uninterrupted, or secure.
We do not control the third-party platforms our services connect to, and we do not warrant that publishing to them will remain available, timely, or successful. A platform may change or withdraw its API, change its rules, impose limits, or refuse a post at any time.
8. Limitation of Liability
To the maximum extent allowed by law, Fibonacci Impact LLC is not liable for any indirect, incidental, special, punitive, or consequential damages, or for any loss of profits, revenue, data, goodwill, or reach, arising from your use of our services.
To the maximum extent allowed by law, our total aggregate liability arising out of or relating to the services is limited to the greater of the amount you paid us for the services in the twelve months before the event giving rise to the claim, or USD 100.
You agree to use our websites and apps at your own risk.
9. Indemnity
You agree to indemnify and hold harmless Fibonacci Impact LLC and its officers, employees, and contractors from any claim, demand, loss, or expense (including reasonable legal fees) arising out of the content you publish through our services, your breach of these Terms, or your breach of the terms or policies of any third-party platform.
10. Suspension and Termination
You may stop using our services at any time, and you may disconnect any connected account at any time. We may suspend or terminate access where you breach these Terms, where required by a third-party platform, or where necessary to protect our services or other users.
11. Changes to These Terms
We may update these Terms from time to time. We will change the “Last Updated” date above, and where a change materially affects your rights we will make reasonable efforts to notify you. Continued use of our services after a change means you accept it.
12. Governing Law
These Terms are governed by the laws of the United Arab Emirates, and the courts of Sharjah, United Arab Emirates have exclusive jurisdiction over any dispute, without prejudice to any right you may have under the law of your own country of residence to bring proceedings there.
